Supreme Court Rules Against Recent US Tariff Action; Fed Admin Imposes New Tariffs in Retaliation

What’s Happened?

  • The Supreme Court ruled 6–3 that some the Federal administration’s tariffs notified under the International Emergency Economic Powers Act (IEEPA) were unlawful. In its judgment, the court says that IEEPA authorizes the president to regulate exports and imports during national emergencies, but it does not explicitly grant authority to impose tariffs, which are considered a form of taxation reserved to Congress.
  • Most reciprocal tariffs, such as those considering EV components, automobiles etc are struck down. But other tariffs such as say, Section 232 tariffs will remain in place. For example, tariffs on Chinese steel, aluminium etc. are under this category. Some auto parts are covered as well and may still be subject to tariffs.
  • In the aftermath of the decision, the administration reimposed a sweeping 15% tariff on all trading partners by way of an executive order through Section 122, which allows a tariff of up to 15% for 150 days to address any balance-of-payments-related deficits. However, Congress would have to approve any extensions beyond 150 days.

Possible Market Implications?

  • Uncertainty will continue to persist as the administration tries to bring its tariffs back in a more robust manner. Some disruption to ongoing trade agreement negotiations is likely; and possible supply chain (re)calibration.
  • Impact on carbon and clean fuel markets is a derivative that will emerge once the first order items mentioned above are clearer.

What’s Next?

  • Uncertainty remains around refunds of tariffs already paid. Ongoing trade negotiations will likely be disrupted as well due to this change.
  • The administration likely to continue to actively find alternate pathways to impose tariffs.
