The California Air Resources Board (CARB) has issued a Third Notice of Public Availability of Modified Text (Third 15-Day Notice) regarding its proposal to permanently adopt the Emergency Vehicle Emissions Regulations. The proposed regulatory action confirms that earlier, antecedent emissions standards remain operative while legal challenges surrounding federal actions against California’s Clean Air Act preemption waivers (specifically targeting Advanced Clean Cars II and the Heavy-Duty Low-NOx Omnibus rules) are resolved in court. Following initial approval at the March 26, 2026 public hearing and subsequent 15-day comment periods released on April 3 and June 30, 2026, CARB determined that additional text modifications were necessary to correct inadvertent errors introduced in the Second 15-Day Changes. The Third 15-Day Notice opens a public review window through August 5, 2026, during which CARB will accept written comments strictly limited to the newly modified regulatory text across specified sections of Titles 13 and 17 of the California Code of Regulations. Under California’s Administrative Procedure Act and Public Records Act, all submitted written comments and associated contact information will become part of the official public record. By completing this formal rulemaking process, CARB seeks to maintain regulatory certainty for motor vehicle and engine manufacturers, ensure continuous market stability for sales within California, and safeguard long-standing public health protections while ongoing federal waiver litigation proceeds.
