Impact Assessment Act Lands Ottawa in Court Again

The Supreme Court of Canada ruled the Impact Assessment Act unconstitutional in October 2023. Despite amendments in June 2024, Alberta argues the changes fail to address the court’s concerns and continue federal overreach. The provincial government has referred the amended Act’s constitutionality to the Court of Appeal, demanding a more focused, streamlined process and greater provincial control. Premier Danielle Smith criticized Ottawa for ignoring both Alberta’s input and the Supreme Court’s ruling.
